If you are a California resident (or soon will be) and you have an impending marriage or domestic partnership, you have only three pathways to obtain a California prenup  agreement (prenup).  Here they are:

You buy a 450-page prenup book online for $30 and/or then spend 3 or 4 months trying to understand it and scratching around the web for samples, templates and insights. It’s cheap. It CAN be done, but it will be highly stressful if you have a job or a life.

But here’s the real reason DIY is a false economy in California prenup agreements. Under California Family Code 1612(c), a prenup agreement provision regarding spousal support shall not be enforceable against either of you unless that person was represented by independent counsel (means a different lawyer for each of you) at the time the prenup was signed. That means you must hire those lawyers (NOT just consult them) and be able to prove to a future court that both of you hired his or her own lawyer.

When the lawyers you hire to cover that legal requirement after you have put together your own DIY prenup agreement see what you’ve done without them and at no cost, what do you think those lawyers will try to do? They will not appreciate your initial attempt to avoid them.  They will seek to recover what they deem to be lost income by punishing you with all kinds of criticisms concerning your DIY prenup agreement. Everything will be wrong with it, and SOME things will likely be wrong.  All of that will lead to a higher fee just for the review of your prenup. That’s what lawyers are like!
